This page contains the terms & conditions. Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.
Ordering & Payments
Once you have emailed your cake details (including date, number of servings, design and delivery details) you will be sent a quote via email. This quote is valid for 7 days from the date of issue.
If you accept the quote given you are required to reply to the email within a reasonable time frame (2-3 days).
Once your acceptance email has been received you will be emailed an invoice. To confirm your booking you are required to pay a deposit as soon as possible. Without this deposit the booking is open to other clients. The date will not be held for you without this deposit.
Final payment is due 30 days from the event date. If payment is not received and you do not respond to requests for payment your order will be cancelled and you will forfeit your deposit. If your payment is late please contact us as soon as possible and promptly pay the balance to avoid cancellation.
If you have placed your order with in two weeks before the event, this is considered a last minute order. You are required to reply to all correspondence promptly and make full payment immediately. Failure to do so will result in the cancellation of our order.
Payment can be made by credit card or bank transfer. Details are provided on the invoice.
A deposit of $100 is required to confirm the booking + any costs for materials that need to be specially ordered for your cake (eg. cake toppers). If the order is less than $100 you are required to pay 50% of the invoice total. The deposit covers administration costs and is not refundable.
Order Collection
If you have opted to collect your order please make contact one week before your event and confirm your collection location (Byron Bay or Ewingsdale), the date and the time you wish to collect.
If you are collecting from Ewingsdale (The Kitchen) you will need to make an appointment as The Kitchen is not always manned. You are expected to arrive for your collection appointment promptly. If you are running late you will need to make contact to notify us. If you arrive outside of your allocated time and nobody is at the premises you will need to make another appointment at a suitable time.
If you are collecting from Byron Bay you do not need to make an appointment, however, you do need to give a time frame of when you plan to collect. We will need to make sure the venue is open at the at your preferred time and we also need to make sure the cake arrives before you do.
Once you have collected your order and left the premises we are not liable for any damage or spoilage. By opting to collect your order you or your representative have assumed all responsibility for the handling of the product.
Order Delivery
Delivery is available for some orders and is charged according to distance travelled. Additional fees may apply for unsealed roads or difficult to access properties. Byron Bay Cake Boutique does have a restricted delivery zone so please check your location before ordering.
You must provide clear directions to the property and give a contact person for the day as well as their phone number. If you have a wedding planner, please provide their details in your initial enquiry.
A delivery date and time will be agreed upon by both parties. If nobody is at the address to receive the order, the order will be taken back to our premises and it is then the customers responsibility to collect the product at an agreed time. It is possible to arrange another delivery, however, a new delivery fee will be applied. Payment of this delivery fee is required before the delivery will be attempted again.
If set up is required at the venue please have an allocated area for the set up with all equipment present, eg. table, cake stand, flowers, cake topper etc.
Changes to Design
Minor changes to design will be accepted after a deposit has been paid, and up to 30 days before your event.
Flavour changes can be made 14 days from your event date and is subject to availability.
If changes are made to the design Byron Bay Cake Boutique reserves the right to amend the price accordingly.
Up to two minor changes are permitted. All changes after this will incur an administration fee of $50. Major design changes will also incur this fee.
Any product ordered from a picture of a different cake makers work will not be an exact preproduction. Byron Bay Cake Boutique will have our own artistic interpretation of the product.
On some rare occasions there could be changes to the agreed upon design due to factors such as availability, supply and weather events. These changes are made at Byron Bay Cake Boutique’s discretion and are subject to artistic licence. Should change need to be made no further correspondence will be entered into.
Photography
Byron Bay Cake Boutique reserves the right to take and use any photos for media related activities, such as social media, advertising, and on our website.
Allergies
Byron Bay Cake Boutique will not be responsible for any allergy related issues
All products may contain or come into contact with wheat, soy, nuts and other allergens. It is the client’s responsibility to inform their guests of any risks.
Force Majeure
Events outside Byron Bay Cake Boutique's control, which is not reasonably foreseeable, shall be considered force majeure, meaning that Byron Bay Cake Boutique is released from Byron Bay Cake Boutique's obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.
Storage
Cakes and other products covered in, or made of fondant, should not be refrigerated as they may ‘sweat’ with condensation. This can cause colours to run or breakdown of the sugar.
Fondant cakes should be stored in a dry, cool place away from direct sunlight. Air-conditioning is recommended.
Buttercream cakes should be stored in the refrigerator. In cooler weather it is possible to store them in a dry, cool place away from direct sunlight and away from heat.
It is recommended that buttercream cakes are taken out of the refrigerator one hour prior to serving.
All products are made to be eaten on the day of the celebration.
Cake, Cupcake and Macaron Stand Hire
A security deposit must be paid for all hired equipment prior to collection.
The hire fee covers 3 days of hire. Returning the stand after this allocated time may result in further charges.
If hired items are returned in unclean condition a cleaning fee may be deducted from the security deposit.
Any damages will result in the loss or partial loss of the security deposit to cover costs of repair or replacement.
The security deposit or partial deposit will be refunded to your account within 30 days of the return of the item. Please forward your bank details so we can process this for you.
Cancellations & Postponements
All request for cancellations and postponements must be made in writing.
If you need to cancel your order you must give at least 30 days notice. You will receive a refund, minus the deposit paid + any additional costs for materials purchased for your order, if you have allowed this time frame.
If cancellation is falls within 30 days of your event there will be no refund given.
Refunds will be paid back into your account within 30 days of cancellation. Please provide your bank account details so we can process this for you.
If you did not receive a refund from your cancellation the non-refunded balance (not including the deposit) may be credited toward future purchases.
If you need to postpone your event you must give at least 30 days notice. The new date is subject to availability. If your date is not available you will receive a refund, minus the deposit and any additional costs for materials purchased for your order.
Please note that by changing your date there is the possibility of a price increase. This is a result of price increases to our ingredients and materials that occur throughout the year. For example, a quote given in 2022 may differ from a quote given in 2023 due to inflation.
You can postpone up to 2 times with no penalty. After this an administration fee of $50 will be applied for each change of date.
COVID-19
Byron Bay Cake Boutique understands the uncertainties pertaining to COVID-19 and will do our best to accomodate postponements.
If you need to postpone your event due to COVID-19 government restrictions please make your request in writing as soon as possible. A new date will need to be agreed upon by both parties. All funds already paid will be transferred to the new date.
Moving your date is subject to availability. If your new date is not available you will receive a full refund, minus the deposit and materials purchased for your order.
Please note that by changing your date there is the possibility of a price increase. This is a result of price increases to our ingredients and materials that occur throughout the year. For example, a quote given in 2022 may differ from a quote given in 2023 due to inflation.
wo postponements will be accepted with no penalty, however, more than two date changes will incur a rebooking fee of $50 to cover administration costs.
If you need to cancel your order due to COVID-19 government restrictions please make contact in writing as soon as possible and refer to our Refund Policy above. This policy stands in the event that you or someone in your party contracts COVID-19, or in the case of government mandated restrictions.
In the unlikely event that Byron Bay Cake Boutique is unable to complete your order due to contracting COVID-19 and alternative cake maker will be sourced, subject to availability. There is the possibility that pricing will vary from the original quote. If a new cake maker cannot be sourced you will be given a full refund.
In the event that Byron Bay Cake Boutique is identified as a close contact of someone with COVID-19 you will be notified straight away. Information published by Centres for Disease Control & Prevention (CDC) states that “there is no evidence to suggest that handing food or consuming food is associated with COVID-19”. If you agree to proceed with the order a third party can be arranged to collect and deliver your order to you, or we can arrange for contactless pick up by you or someone in your party.
